What is Escheatment?

Escheatment is a required process for USA-based companies through which financial assets (such as bank accounts, shares of stock, and insurance policies) must be turned over to a government agency when they are deemed to have been “abandoned” by the original owner. Escheatment laws vary greatly between the various state, federal and local jurisdictions, however, most accounts become abandoned for the following three reasons:

  • There is no owner contact for an extended period of time 
  • The mailing address or contact information becomes outdated 
  • The account owner passes away and the account has not been claimed by the heirs 

Often, the seized accounts are liquidated, and the proceeds are used by the government until a claim is submitted by the owner or the heirs.

William Palmer

Mr. Palmer founded Palmer Law Group in 1990 after a distinguished career in public service. His firm provides legal services to clients in all types of commercial and class-action litigation, including all facets of unclaimed law and litigation. He is a recognized leader in the field of unclaimed property law and has helped clients in the US and abroad recover funds held by federal, state, and municipal governments.

Daniel Rivers
